Abstract

The paper provides an interpretation of article 443 bis of the Chilean Penal Code, incorporated under Law 20.601, which established a separate sentencing framework for burglary of automated teller machines, dispensers or containers of money, or the money and securities held within. The legal amendment provides a special punitive treatment for the attack of certain objects whose particular functional characteristics serve to satisfy individual interests related to the unobstructed access to financial services. According to this perspective, the paper aims to determine the structure of this crime, as well as to specify the meaning of legal terms regarding the material object of the offense and specific modalities of force described in article 443 bis.
