Abstract

The article inquires into the function of the so called “care requirements” (Sorgfaltsanforderungen) within the grounding of negligent criminal liability. For that purpose, it offers an analytical reconstruction of crime based on the notions of norm, duty and action, which allows to make a clear distinction between the violation of a norm, as the object of the imputation of (negligent) criminal liability, and the non-observance of a care requirement, as a grounding criterion of such imputation. Finally, and on this ground, the article examines the role played by the concept of “tolerable risk” (riesgo permitido) and by the individual circumstances of the wrongdoer in the grounding of care requirements.
