Iusphilosophical remarks on the criminal liability of organizations

Abstract

The article seeks to problematize some premises of the argument against the criminal liability of organizations. To do so, it discusses first the relationship between Criminal and Administrative Law; then explores the nature of juridical persons and organizations in general as subjects of imputation, and finally links the above to the concept of criminal punishment. The roots of the central argument of this article are to be found already in the philosophy of the Middle Ages and the Enlightenment.
